Terms of Service

1. Acceptance of Terms

By downloading, installing, or using any application published by UpJoyAP ("we", "us", "our"), including Jigsaw Puzzles Master and Sudoku EyeCare (collectively, "the Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Apps.

These Terms work alongside our Privacy Policy, which describes how we collect and use your data. By using the Apps, you also agree to our Privacy Policy.

2. Description of Services

2.1 Jigsaw Puzzles Master

A puzzle game application available on iOS and Android that provides:

• Daily updated puzzle challenges
• Multiple difficulty levels of jigsaw puzzle games (36 to 400 pieces)
• 14+ puzzle categories with HD images
• Personal game progress tracking
• Achievement and leaderboard systems

2.2 Sudoku EyeCare

A mobile puzzle game application available on iOS that provides:

• Classic Sudoku gameplay with four difficulty levels
• Integrated eye-care features (20-20-20 rule reminders, fatigue detection, guided eye exercises)
• Eye-care color themes designed to reduce eye strain
• Daily challenges with streak tracking
• Achievement system with 15 achievements

2.3 Advertising

All of our Apps are free to download and use. To support development and keep our Apps free, they display advertisements through Google AdMob and third-party ad networks. Ads may be personalized based on your preferences if you consent to tracking, or non-personalized if you do not.

3. User Eligibility

• The Apps are rated for all ages (4+ on App Store, Everyone on Google Play) and are suitable for users of all ages.
• Users under 13 years old (or the applicable age of consent in your jurisdiction) should use the Apps under parental or guardian consent and supervision.
• No account creation or registration is required to use the Apps.
• Users must comply with all applicable laws and regulations in their jurisdiction.
• By using the Apps, you represent that you have the legal capacity to enter into these Terms, or that a parent or guardian has agreed on your behalf.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Apps for personal, non-commercial use only, on devices that you own or control, as permitted by the applicable app store terms of service (Apple App Store Terms of Service or Google Play Terms of Service).

5. Restrictions on Use

You agree not to:

• Copy, modify, distribute, sell, or lease any part of the Apps
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Apps
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the Apps
• Use the Apps for any unlawful, unauthorized, or commercial purpose
• Use automated tools, bots, scrapers, or robots to interact with the Apps
• Attempt to gain unauthorized access to any part of the Apps, related systems, or networks
• Interfere with or disrupt the integrity or performance of the Apps
• Transfer, sublicense, or assign your rights under these Terms to any third party
• Circumvent, disable, or interfere with any security features of the Apps
• Engage in any behavior that may harm other users' experience

6. Intellectual Property

6.1 Ownership

All content, features, and functionality of the Apps — including but not limited to the design, graphics, user interface, algorithms, images, audio, text, code, and game mechanics — are owned by UpJoyAP and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Trademarks

"Jigsaw Puzzles Master", "Sudoku EyeCare", "UpJoyAP", and associated logos are trademarks of UpJoyAP. They may not be used without our prior written permission.

6.3 User Feedback

If you submit any content, feedback, or suggestions, you grant us a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and incorporate such content into our products and services.

7. Third-Party Services and Content

The Apps integrate third-party services including Google Firebase (analytics and crash reporting) and Google AdMob (advertising). These services are governed by their own terms and privacy policies:

We are not responsible for the content, practices, or policies of any third-party services. Advertisements displayed in the Apps are provided by third-party ad networks, and we do not endorse or guarantee the products or services advertised.

8. In-App Purchases and Payments

Some of our Apps may offer optional paid content, features, or the removal of advertisements through in-app purchases. By making a purchase:

• All transactions are processed by the applicable app store (Apple App Store or Google Play) and are subject to their payment terms.
• Prices are displayed in your local currency within the app store.
• All purchases are final unless otherwise required by applicable law.
• Refund requests should be directed to the applicable app store according to their refund policies: Apple Refund Policy or Google Play Refund Policy.

9. Eye-Care Disclaimer

The eye-care features in Sudoku EyeCare (including break reminders, the 20-20-20 rule prompts, and guided eye exercises) are designed for general wellness purposes only. They are not medical devices and are not a substitute for professional medical advice, diagnosis, or treatment. If you experience eye discomfort or vision problems, consult a qualified healthcare professional.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The Apps are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
• We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
• We do not warrant that the Apps will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• We do not warrant that defects will be corrected or that the Apps will meet your specific requirements.
• We are not responsible for any content or conduct encountered through advertisements displayed in the Apps.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UPJOYAP SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages arising from your use or inability to use the Apps
• Any damages arising from unauthorized access to or alteration of your data
• Any damages arising from third-party conduct or content within the Apps

In no event shall our total aggregate liability exceed the amount you actually paid for the Apps (if any) in the twelve (12) months prior to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless UpJoyAP and its affiliates, officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Apps
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights

13. Service Modification and Termination

We reserve the right to:

• Modify, update, suspend, or discontinue the Apps (or any part thereof) at any time, with or without notice.
• Terminate or suspend your access to the Apps at any time for violation of these Terms or any other reason.

Upon termination, the rights granted to you under these Terms will immediately cease. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall continue to apply.

You may terminate this agreement at any time by uninstalling the Apps from your devices.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Effective Date" at the top of this page.
• For material changes, we may provide notice through in-app notifications, app store update notes, or email (if you provided one).
• Your continued use of the Apps after changes are posted constitutes acceptance of the revised Terms.
• If you do not agree to the revised Terms, you must stop using and uninstall the Apps.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Apps shall be resolved as follows:

• Informal resolution: We encourage you to contact us first at support@upjoyap.com to attempt to resolve any dispute informally.
• Formal proceedings: If informal resolution is unsuccessful, disputes shall be submitted to the competent courts in the jurisdiction where UpJoyAP is registered.

16. App Store Additional Terms

If you downloaded an App from the Apple App Store or Google Play Store, the following additional terms apply:

• These Terms are between you and UpJoyAP only, not with Apple Inc. or Google LLC.
• Apple and Google have no obligation to provide maintenance or support for the Apps.
• In the event of any failure of the Apps to conform to applicable warranties, you may notify the app store for a refund (if applicable); beyond that, the app store has no other warranty obligation.
• Apple and Google are not responsible for addressing any claims relating to the Apps, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and Google and their subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the complete and exclusive agreement between you and UpJoyAP regarding the Apps, superseding all prior or contemporaneous understandings, agreements, or communications.
